1. Parties

This Content Creator Agreement (“Agreement”) is entered into by and between:

K Squad Social LLC (“KinkySquad”, “Company”, “Platform”), a company incorporated under the laws of the United States with its principal office at 2125 Olive St, Ramona, CA 92065.

The individual registering as a Creator/Model on kinkysquad.com (“Creator”, “You”, “Your”).

By creating an account and uploading content, you agree to the terms and conditions outlined in this Agreement.

2. Eligibility & Age Verification

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to register as a Creator.

All Creators must provide a valid government-issued photo ID and a selfie holding the ID to complete age and identity verification.

Access to publish and monetize content will only be granted once verification is approved.

3. Consent and Rights of Participants

You affirm that all participants featured in your content are at least 18 years old, have provided valid identification, and have granted explicit written consent for the recording and distribution of the content.

You are responsible for obtaining, storing, and presenting model releases upon request.

4. Content Ownership & License

You retain full ownership of the content you create and upload.

By uploading, you grant KinkySquad a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote your content for as long as it remains on the platform.

You acknowledge that this license is necessary to operate the platform, including streaming, user access, and promotional features.

5. Prohibited Content

The following content is strictly prohibited:

Non-consensual sexual acts (real or simulated).

Content involving minors or individuals who cannot provide consent.

Incest, bestiality, trafficking, or exploitation.

Content infringing on intellectual property rights of third parties.

Illegal activities under U.S. or international law.

Violations may result in immediate removal, suspension, or permanent ban, and reported to authorities if required.

6. Moderation & Compliance

All uploaded content is subject to real-time review by KinkySquad’s moderation team.

Livestreams are actively monitored, and any prohibited behavior may result in immediate termination of the stream.

Users and creators can report inappropriate content via the “Report” function or by email to support@kinkysquad.com.

7. Monetization & Payments

Creators may earn revenue through subscriptions, tips, pay-per-view (PPV), and livestreams.

Payments are processed by authorized third-party payment processors (e.g., Segpay, CCBill, Vendo, Epoch, etc.).

Payouts will be issued via the Creator’s designated method (e.g., bank transfer) in accordance with payment processor terms.

The Platform may deduct a service fee (percentage subject to processor and business terms).

8. Refunds

Creators are not responsible for direct refunds. Refunds are handled by KinkySquad according to the Refund Policy available on the website.

In cases of chargebacks or fraud, KinkySquad reserves the right to deduct the disputed amount from future Creator payouts.

9. DMCA & Copyright

KinkySquad complies with the Digital Millennium Copyright Act (DMCA).

Creators agree not to upload copyrighted material without permission.

Repeated infringement may result in account termination under our Repeat Infringer Policy (RIP).

10. 2257 Record-Keeping Compliance

In compliance with 18 U.S.C. § 2257, Creators must maintain age and identity records of all models featured in their content.

Records must be available for inspection upon request.

11. Anti-Trafficking Policy

KinkySquad enforces a zero-tolerance policy against human trafficking, exploitation, and non-consensual sexual activity.

Any suspected trafficking or exploitation will be reported immediately to the proper authorities.

12. Termination

KinkySquad reserves the right to suspend or terminate Creator accounts for violations of this Agreement, Terms of Service, or applicable law.

Creators may terminate their account at any time by written request.

13. Governing Law

This Agreement is governed by the laws of the State of California, United States, without regard to conflict of laws principles.
