1. Introduction

K Squad Social LLC (“KinkySquad,” “we,” “our,” or “us”) respects the intellectual property rights of others and expects its users to do the same. In compliance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy concerning allegations of copyright infringement related to content hosted on kinkysquad.com.

This DMCA Policy explains how copyright holders can notify us of alleged infringements, how we respond, and what rights users have if their content is removed.

3. Filing a DMCA Takedown Notice

If you believe your copyrighted work has been copied, used, or distributed in a way that constitutes copyright infringement on kinkysquad.com, you may submit a written DMCA Notice of Infringement containing the following information (as required by 17 U.S.C. § 512(c)(3)):

Identification of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list is acceptable.

Identification of the material you claim is infringing (or subject to infringing activity) and information sufficient to locate the material on our site (e.g., URL).

Your contact information, including your name, mailing address, telephone number, and email address.

A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.

Your electronic or physical signature.

You may send your completed DMCA Notice to our Designated DMCA Agent at the contact information provided above.

4. Response to Takedown Notices

Upon receiving a valid DMCA Notice, we will:

Promptly remove or disable access to the allegedly infringing content.

Notify the user (the “Content Provider”) who uploaded or posted the material.

Provide the Content Provider with information on how they may file a Counter-Notification if they believe the takedown was a mistake or misidentification.

5. Filing a Counter-Notification

If you are a Content Provider whose material has been removed (or access disabled) due to a DMCA Notice, and you believe the removal was improper, you may file a written Counter-Notification that must include:

Your physical or electronic signature.

Identification of the content removed or disabled, and the location where it appeared before removal (e.g., specific URL).

A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district of your address (or if outside the United States, for the judicial district in which our company is located), and that you will accept service of process from the complainant or their agent.

6. Repeat Infringer Policy

KinkySquad enforces a strict Repeat Infringer Policy (RIP). Users who are found to repeatedly upload or share infringing content will have their accounts terminated. A copy of our RIP is available upon request.

7. Misrepresentations Under the DMCA

Please note that, under the DMCA:

Any person who knowingly misrepresents that content is infringing may be held liable for damages, including costs and attorneys’ fees (17 U.S.C. § 512(f)).

Similarly, submitting a false Counter-Notification may also result in liability.
