The privacy policies of KinkySquad — K Squad Social LLC (“KinkySquad,” “we,” “us,” or “our”) describe how we collect, use, and protect your data in connection with your use of the Service (as described in our Terms of Use).
By visiting our site, using the Services, or otherwise using, installing, or downloading any KinkySquad software or applications associated with the Service, you agree to the practices described in this Privacy Policy and you authorize the collection, use, and disclosure of your information—including personally identifiable information—as described here. Use of the Services is governed by our Terms of Use, and this Privacy Policy is incorporated into and forms part of the Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Use.
Applicability; Personal Information
This Privacy Policy applies to your use of the KinkySquad website located at https://www.kinkysquad.com/ and all other aspects of the Services (as defined in our Terms of Use). Except as expressly stated, this Privacy Policy does not apply to any third-party applications or technology integrated with our Services, nor to any other third-party products, services, or businesses, or third-party websites you access via links or otherwise while using the Services (“Third-Party Services”). Data you provide to or collected by Third-Party Services is subject to those providers’ practices, not ours. You should review their privacy policies (and any other applicable terms) before sharing your data with them.
In connection with your use of the Services, we may receive various types of information about you, as well as information you provide about others. Sometimes you provide this data; sometimes it is collected automatically. To the extent data is associated with an identified or identifiable natural person and protected as “personal information” (or a substantially equivalent term) under applicable data-protection laws, we refer to it as “Personal Information.” You acknowledge and agree that we may collect, process, store, access, and disclose Personal Information you provide in order to facilitate provision of the Services and related support as described in this Privacy Policy.
Information You Provide Through Your Account
When you create or update your account, or otherwise interact with us regarding your account, you provide certain Personal Information, including:

We use this information to provide account-related components of the Services and to prevent fraud, abuse, or misuse of our Platform and Services. Your username may be publicly displayed and available to other users.
Creators
Creators provide the information above when creating accounts. To receive payouts, Creators must set up an account with one of our payment processors (we reserve the right to select different or additional processors; as of this Policy, this includes ClubPago) and provide certain tax and bank information. Depending on your jurisdiction, you may be asked for some combination of:
Full legal name
Address
U.S. Social Security Number (if applicable) or other personal identifier
Date of birth
Bank account details for payouts
Tax identification number
Phone number
Signature
We use your tax and payout information to provide the Services (including payment processing). We do not disclose your tax or payout information to third parties other than service providers performing aspects of the Services or to tax authorities as required by law. Your payout information is also subject to your selected processor’s privacy policy.
Subscribers
Subscribers provide the information above when creating accounts. Subscribers must also provide payment information to a payment processor to facilitate subscription or other Service payments. We try to limit the payment information we receive from processors; however, we may access certain details to provide the Services, including for customer-service issues. We use this information to provide the Services and do not share it with third parties other than service providers performing aspects of the Services or as required by law.
We collect and process information about the Creators you subscribe to and your activities on the Platform as a Subscriber to provide and improve our Services.
Additional Information We Collect
Automatically Collected Information
Our Platform (and/or third-party analytics providers) collects information as you use the Site, such as device type(s), IP address, ISP, geolocation, browser type/configuration, add-ons, language preference, default email app, referring/exit sites, OS, timestamps, cookie data, pages visited, and user activities. We may also infer your country from self-disclosure, IP address, and/or payment information.
Cookies
The Services may use cookies and similar third-party tracking technologies that collect information about your use of the Services. Session cookies expire when you close your browser; persistent cookies remain until you or your browser delete them or they expire. You can configure your browser to block or alert you about cookies, but doing so may limit functionality.
Forums, Messages, and Comments
When you participate in forums or send communications via the Services, we collect your comments and log visit counts, on-site activity, reply locations, private messages, IP address, and last-login location. Where we facilitate direct user-to-user communications, messages you send via the Platform may be publicly available to users and others depending on context.
User Surveys
We may invite you to participate in surveys (e.g., gender, ethnicity, race, age, sexual orientation, income, accessibility) to better serve our user base. Participation is optional. If you participate, we store responses and use them to evaluate, deliver, and potentially adjust products and services.
Activity on Your Account
We collect and process information about your use of the Services, including (if you are a Subscriber) the Creators you subscribe to and the support you provide, and (if you are a Creator) the users who subscribe to your page and their support, as well as the content of messages sent via the Platform.
Communications With Us
We receive Personal Information in your service, technical, and administrative emails/messages. Service-related communications (e.g., maintenance/security notices) are essential and you cannot opt out. Marketing communications (e.g., new features and offers) are optional; you may opt out via unsubscribe links or email-preferences in your account.
Other Information You Provide
Various parts of the Services let you submit content (e.g., posts/comments, messages, or communications with us). We treat that information consistently with this Policy. However, we are not responsible for reviewing user-submitted content to identify sensitive information you may have included. If you post sensitive data publicly, it may be visible to others.
How We Use Your Information
We process your information (including Personal Information where applicable) to:
Facilitate and provide the Services (account access; Creator pages; subscriptions; payment processing and payouts).
Verify identity to provide the Services and comply with law.
Communicate regarding your account, respond to inquiries, and offer existing/improved Service features.
Promote our Platform and Creators’ pages and content.
Market our products/services (unless you opt out).
Evaluate how you use the Services.
Test and improve the Platform and Services (including R&D for future offerings).
Prevent fraud, abuse, or misuse of the Platform.
Information We Share With Creators
When you subscribe to a Creator’s page, you agree we may share with that Creator:
Profile information you provided (e.g., username, email).
Messages you send to the Creator.
Information about your subscription to that Creator (pricing and start date). We do not provide full payment-card details to Creators.
Usage data related to your access and use of the Creator’s page.
Creators must accept our Data Processing Agreement (DPA) governing how they use Personal Information received via the Services.
Information We Share With Third Parties
Except as described here, we will not use or disclose your Personal Information for purposes other than those reasonably necessary to perform the Services and related support. As a matter of policy and without your express consent, we do not sell or rent information about you, and we do not disclose information in a manner inconsistent with this Policy, except as required by law or regulation.
We cooperate with law-enforcement investigations and other third parties to enforce laws regarding IP rights, fraud, and other personal rights. We may (and you authorize us to) disclose information about you to law enforcement, government officials, or other third parties at our sole discretion in connection with investigations of fraud, IP infringement, or other unlawful activities, or activities that may expose us or you to liability.
Subject to the foregoing, we may share/disclose information:
With your consent.
By law or to protect rights. To respond to legal process, investigate policy violations, or protect the rights/property/safety of Creators or third parties (including fraud protection and credit-risk reduction).
Service delivery. Employees/contractors may access data as needed under confidentiality to perform the Services and related support.
Interactions with other users; posts. Other users may see identifying information and descriptions of your publicly shared activity.
Affiliates. We may share with our affiliates (parent, subsidiaries, joint ventures, or commonly controlled companies) subject to this Policy.
Third-party providers. We engage service providers (e.g., email, hosting, cloud/IAAS, data processing/storage). We take commercially reasonable steps to select reputable providers and to require appropriate security measures; however, we cannot guarantee their actions and assume no liability for their conduct.
Third-Party Services. You may enable integrations; when enabled, we may share certain data necessary for the integration. Third-Party Services are not controlled by KinkySquad; review their privacy notices and settings.
Business changes. In a merger, acquisition, financing, bankruptcy, dissolution, reorganization, sale of assets/shares, or similar (including due diligence), data may be shared/disclosed subject to standard confidentiality.
Aggregated/De-identified data. We may use or disclose data that is aggregated or de-identified for any purpose (e.g., statistics, research, analytics, service development).
Agreement enforcement. To secure compliance and enforce contractual/legal obligations.
Protection of rights. To protect and defend our rights and property (including IP) and ensure compliance with applicable laws and third-party rights (including IP and privacy).
Safety and security. To protect your safety, users’ safety, and KinkySquad’s safety, including our personnel and contractors.
Information Shared Publicly/With Other Users
The following may be visible to other users:
Your public profile (name and username) to any Creator whose page you subscribe to.
Any posts, likes, or comments you make, or other information you transmit publicly.
If you are a Creator, your username and all content you post on your Creator page to your Subscribers. Creators may block a Subscriber; we will then cancel that subscription and may refund a remaining portion at our sole discretion where applicable.
Your Data Preferences and Rights
Marketing Activities
Unless you opt out, you agree that we may:
Show you marketing communications about our services/products while you are on our Site or Platform.
Send marketing communications about services/products related to your existing services by email or SMS (if you subscribed to SMS service/event notices).
Send service-related messages independent of your existing service by email (you may opt out of these marketing emails, but not essential service notices).
Opting out of marketing: Email support@kinkysquad.com. Please allow up to 30 days to process. You will continue to receive essential account/service communications. We will not sell your information to third parties for marketing without your prior consent.
Deleting Your Account
You may request deletion by emailing support@kinkysquad.com. If you want to transport your data, download it first. We may retain information as reasonably necessary to comply with laws.
Jurisdiction-Specific Notices
California Residents
We do not disclose your Personal Information to third parties for their direct-marketing purposes. You may prevent future disclosures for direct marketing at no charge by emailing us at the address under Contact.
Nevada Residents
Nevada residents may have the right under applicable law to opt out of the sale of Personal Information. To submit such a request, contact us using the information below.
EU Residents
Users of our Services consent to processing in the United States. If you are an EU resident and want your data securely deleted from our systems (to the extent technically feasible and lawful), email proof of EU residency to support@kinkysquad.com. We will cooperate in good faith, subject to legal/accounting obligations and other applicable standards.
International Data Transfers
KinkySquad primarily processes and stores data in the United States. Our third-party providers may process data in other countries. We will take steps to ensure your Personal Information remains protected consistent with this Policy and applicable law. Courts or authorities in other countries may, in certain circumstances, have access rights.

Authorized Agent
You may designate an authorized agent to make a request on your behalf by providing a valid power of attorney, the requester’s government ID, and the agent’s government ID. Contact support@kinkysquad.com. To protect your account, we may deny access or recovery at our discretion.
Our Data Retention Period
We generally retain account information for 365 days after the account was last active, unless you delete or request deletion. Certain information may be retained thereafter as required by law.
Security
We maintain reasonable physical, technical, and administrative safeguards appropriate to the nature of the information and the circumstances of collection. However:
You provide information (including Personal Information) at your own risk.
No internet transmission is 100% secure; we cannot guarantee against unauthorized access, hacking, loss, or breaches.
You are responsible for protecting account credentials and ensuring others cannot use them.
Children
The Services are not directed to or intended for children. We do not knowingly collect, process, or store Personal Information via the Services from anyone under 18 years old. If we learn we have inadvertently collected such information without verifiable parental consent, we will promptly delete it or obtain required consent consistent with COPPA. Please do not provide Personal Information for anyone under 18.
Changes
We may update this Privacy Policy from time to time, in whole or in part, at our sole discretion by posting an updated version on the Site or within the Services. We will revise the “last updated” date and use commercially reasonable efforts to notify you (e.g., email, in-Service notice, and/or a prominent Site notice). Changes take effect immediately upon posting. Continued use of the Services constitutes acceptance. If you do not agree, your remedy is to stop using the Services and deactivate your account.

Referral Program Terms
WARNING!
In accordance with Regulation 3 of the Trading Scheme Regulations 1997 (as amended) and Section 120(1) of the Fair Trading Act 1973, please read the following warning regarding KinkySquad’s Referral Program:
It is illegal for us or for any participant (including Referring Users and Referred Creators) to persuade anyone to make a payment by promising benefits for recruiting others into the Referral Program.
Do not be misled by claims that high earnings are easily achieved through participation.
Although we do not require payment to participate, if you sign this agreement you have 14 days to cancel and receive your money back.
Introduction
These Referral Program Terms are additional terms that apply if you use KinkySquad’s Referral Program and form part of your agreement with us.
Interpretation
Defined terms have the same meanings as in the Terms of Use for All Users. In addition:
“Referring User” also means “you” or “your.”
“Referred Creator” means a person who joins KinkySquad as a Creator via the Referring User’s unique referral link.
What is the Referral Program?
KinkySquad (operated by K Squad Social LLC) offers a program by which existing Users can introduce prospective Creators and receive referral payments from KinkySquad, calculated and capped as described below.
Program Rules
Only current KinkySquad Users may participate. Suspended/cancelled/deleted accounts are ineligible.
You must add a bank account or payout method in your account settings to receive referral payments.
Each User has a unique referral link (available in your account). Do not impersonate KinkySquad or imply our endorsement when sharing your link. Do not use Google Ads or similar search-ad platforms to promote your link. If requested, disclose your sharing methods in your KinkySquad bio/website field.
The Referred Creator must click your link and register using the same browser session. Registrations not using your link will not be attributed.
The Referred Creator must not have previously opened a KinkySquad account (under any name).
If a Referred Creator opens multiple accounts, referral payments apply only to the first account’s earnings.
No referral payments will be made where we determine the Referred Creator is owned/operated by you or has a business relationship with you. You must provide information we reasonably request to make this determination.
Acceptable Promotion
As a Referring User, you will not misrepresent KinkySquad, our services, programs, or content, and you will not suggest that a Creator will earn a particular amount (or any money) or claim a likely number of Fans.
Referral Payments
Calculation: You will receive 5% of the Referred Creator’s Fan Payments generated during the 12 months after they become a registered User or until you reach a US$50,000 cap per Referred Creator, whichever occurs first.
VAT: Referral payments may be subject to VAT/withholding as applicable (see Creator Terms – Tax/VAT).
Payout method: You must select an available payout option in your country.
Frequency: Referral payments due on Fan Payments made in a calendar month are paid on or about the 1st day of the following month.
Cost: KinkySquad bears the cost of referral payments (not the Referred Creator).
Our Rights
We may recover incorrectly paid amounts.
We may request ID and other information from you and/or the Referred Creator to verify referral payments and recipients; failure to provide may forfeit payments.
We may change or discontinue the Referral Program (including how payments are calculated) at any time, but changes will not deprive you of referral payments already earned from Fan Payments made before changes take effect.
Withholding Referral Payments
We may withhold all or part of unpaid referral payments if we believe you have seriously/repeatedly breached the Terms; attempted or threatened to do so with serious consequences; or if we suspect illegal/fraudulent activity by you, a Fan, or the Referred Creator, for as long as needed to investigate. If we conclude any of the foregoing, we may notify you that payments are forfeited. We may also withhold payments upon notice of a lien/assignment until resolved. We are not liable where we withhold or forfeit payments as permitted. Where a portion is unrelated to breach/illegality, we may arrange to pay that portion.

Who Can Use This Policy?
Users and non-users may use this Policy to raise complaints related to KinkySquad.
How to Submit a Complaint
Email support@kinkysquad.com with your name, address, contact details, a description of your complaint, and—if the complaint relates to Content—the URL of the Content.
Illegal or Non-Consensual Content
Upon receipt:
We will take appropriate steps to investigate within a timeframe suitable to the nature of your complaint.
If we need more information/documents, we will contact you.
We will investigate in good faith within seven (7) business days.
If we are satisfied the Content is illegal or non-consensual, we will promptly remove it and notify you of our decision.
If we are satisfied the Content is not illegal or non-consensual, we will notify you of our decision.
Any dispute about our “non-consensual” determination will be referred by us to a neutral arbitration association at our expense.
Copyright Infringement
Submit copyright complaints in accordance with our DMCA Policy. We will respond as set out in that policy.
Other Complaints (e.g., AUP Violations)
We will take appropriate steps to investigate.
If we need more information, we will request it.
We will act in good faith to address the issue. If Content violates our Acceptable Use Policy, we will act promptly to remove it.
We are not obligated to inform you of the outcome of your complaint.
Unfounded or Abusive Complaints
If you are a KinkySquad user, you warrant that you will not submit complaints that are wholly unfounded, abusive, or in bad faith. We may suspend or terminate your account for breach of this warranty.

Platform-to-Business (P2B) Regulation Terms
Introduction
These P2B Terms form part of the Terms of Service.
Interpretation
Unless stated otherwise, defined terms have the same meanings as in the Terms of Use for All Users.
Do These Apply to You?
These P2B Terms apply to Creators established or resident in Mexico and Latin America. If they apply to you, they form part of your agreement with us.
What These Terms Include
These Terms provide information about our practices to meet fairness and transparency requirements in EU Regulation 2019/1150 (the “P2B Regulation”).
Promotion of Creators via Other Channels
We may promote you via our social accounts (e.g., Instagram: instagram.com/realkinkysquad, Facebook: facebook.com/kinkysquadsocial, X: x.com/kinkysquadsn).
Ranking on KinkySquad
We may randomly suggest Creators a User might follow based on Creators who have earned money on KinkySquad in the last 30 days. We do not operate a ranking system. There is no search/discovery feature.
Complaints Under P2B
Email support@kinkysquad.com if you have a complaint about:
An alleged breach by us of obligations under the P2B Regulation affecting you;
Technology issues directly related to KinkySquad that affect you; or
Measures we have taken or conduct relating directly to KinkySquad that affect you.
Handling Process
Upon receipt, we will:
Consider your complaint and any follow-up needed (including requesting more information/documents).
Handle complaints within a reasonable time, considering importance and complexity.
Communicate the outcome in clear language by email or message to your KinkySquad account.
You and we will act in good faith in any mediation. Attempts to settle disputes via mediation do not affect either party’s right to initiate legal proceedings at any time, as set out in our Terms of Use for All Users.
